Court Restrains Police from Arresting Ihunwo, Adokiye, Others

A High Court sitting in Port Harcourt has granted order of interim injunction restraining Inspector General of Police, IGP, Kayode Etokun, Commissioner of Police Rivers State, CP Olatunji Disu and Martin Amaewhule, their subordinate, agents, privies, proxies and representatives from arresting chairman of National Youth Council of Nigeria, Chijioke Ihunwo, Happy Benneth and Jinjiri Bala.

Justice G.O Ollor in an experte application filed by the applicants’ counsel, Damian Okoro, restrained the defendants from taking further steps in arresting, whisking away, detaining or infringing on the fundamental rights of the applicants pending the determination of the originating motion.

The judge also granted leave to Chijioke Ihunwo, Happy Benneth and Jinjiri Bala to serve the originating processes and all other subsequent processes in the suit on the first and second defendants through the office of the officer in charge of legal, Rivers State Criminal Investigation Department Port Harcourt.

The presiding judge granted leave for the third defendant, Martin Amaewhule to be served through substituted means by pasting it at State House of Assembly Legislative Quarters off Aba road, thereby adjourned to 28 February, 2024 for hearing on the Originating motion/ application.

In a related development, Justice C.N Wali of Rivers State High Court sitting in Port Harcourt has granted an order of interim injunction restraining Nigerian Police and Martin Amaewhule from arresting Chibuike Peter, Adokiye Oyagiri and Progress Joseph.

Justice Wali in his ruling on experte application filed by counsel to the applicants Damian Okoro also restrained the subordinate, agents, privies and representative of the defendants from taking further steps in connection with subject matter of the action or maintaining status quo.

The court equally restrained the defendants and their subordinate, agent’s, privies and representative from arresting, whisking away, detaining or however infringe on the fundamental rights of the applicants pending the determination of the originating applications.

The judge granted leave to Chibuike Peter’s, Adokiye Oyagiri and Progress Joseph to the originating processes and all other subsequent processes in the suit on the first and second defendants via the office of officer in charge of Legal, Rivers State Criminal Investigation Department Port Harcourt.

Justice Wali also granted leave to serve same to the third defendant, Martin Amaewhule through substituted means by pasting it at State House of Assembly Legislative Quarters off Aba road and thereafter adjourned to the 21 February, 2024 for hearing.
